I. Contracting Parties and Scope of Agreement
1.1 The PROXY001 Proxy Product Service Terms are a valid contract between you and PROXY001 (hereinafter referred to as "us") regarding the use of PROXY001 proxy services (including providing API links, account registration services, etc.). The PROXY001 proxy product includes the website with the domain name proxy001.com and all national API interfaces provided within the website.
1.2 If you use or purchase IP proxy services on the PROXY001 proxy website, you may still need to confirm the specific service terms corresponding to the service; please read and fully understand the content of each clause carefully, and choose to accept or not accept the service terms.
1.3 After signing this agreement, the content of this agreement may be modified due to the development of the Internet and changes in relevant laws, regulations, and normative documents, or due to the needs of PROXY001's business development. PROXY001 will directly publish the modified agreement on its website or notify users of the modification through other reasonable means. Such publication behavior is deemed as notification from PROXY001 to the user of the modification content. Users should promptly review and understand the modified clauses when enjoying IP services provided by PROXY001 or using the product, and comply with them. If users have objections to the modified agreement, they should immediately stop using all services and products provided by PROXY001. If users log in to enjoy internet services or continue to use PROXY001 products, it is deemed that the user acknowledges the modified agreement.
1.4 Any declarations, notices, warnings, etc., made by PROXY001 regarding certain specific IP services or products through various methods shall be considered part of this agreement. If users use such IP services or products provided by PROXY001, it is deemed that the user agrees to the content of such declarations, notices, and warnings.
II. Account Registration, Use, and Security
2.1 Eligibility for Registration
2.1.1 You need to confirm that when you complete the registration procedure or actually use this service in other ways allowed by PROXY001, you should be a natural person, legal entity, or organization with full civil capacity and full civil conductive capacity (referred to collectively as "you").
2.1.2 If you are a minor or a person with restricted civil conductive capacity, then you do not qualify as the aforementioned subject. You and your guardian(s) shall bear all consequences resulting from your improper registration actions.
2.2 Account Registration
2.2.1 When you fill out the information according to the prompts on the registration page, read and agree to the service terms, and complete the entire registration procedure, you can obtain a PROXY001 proxy product account and register as a platform user of PROXY001.
2.2.2 The email ("account name") you set or confirmed during registration and the password you set will become your account (email and password together called "account") upon successful registration.
2.2.3 If manual account name setting is required, the account name you set must not violate national laws and regulations, PROXY001's management rules, or cause confusion with your identity and PROXY001's identity. Otherwise, your account may fail to register successfully or PROXY001 has the right to cancel it after notifying you.
2.2.4 You should provide accurate and timely updates to your account information based on legal requirements or according to the prompt on the relevant pages, so that it remains true, timely, complete, and accurate. If the information or data you provide is incorrect, false, outdated, or incomplete, PROXY001 may send an inquiry or request for correction to you, and you should cooperate to provide or update the relevant information as required. Due to inaccurate, untimely, incomplete, or incorrect information you filled in, you shall bear the consequences and losses arising from your inability to use the PROXY001 account (failure to register successfully, account freezing, cancellation, etc.) or during the use process.
2.2.5 For the activation of some products or services, PROXY001 may require you to provide more identity information and undergo further identity verification or qualification verification. Your account can only gain access to related products or services after passing these verifications.
2.2.6 Generally speaking, your PROXY001 account is the unique identity identifier for you to engage in all activities on the PROXY001 website unless otherwise agreed. However, under certain circumstances, PROXY001 has the right to uniformly handle multiple PROXY001 accounts owned by the same and/or associated legal entities based on its judgment. Examples of associated information include: the same ID card, the same email, the same payment account, the same device, the same address, etc.
2.3 Account Usage and Security
2.3.1 You have the right to use the account you set up to log into the PROXY001 website and thus use other services provided by PROXY001.
2.3.2 PROXY001 may notify you of the progress of the service via email or other means and remind you to take the next steps. During the service process, you should log into your PROXY001 account in time to view and perform transaction operations.
2.3.3 A PROXY001 account defaults to being able to independently conduct activities on the PROXY001 website. Unless otherwise stipulated, one PROXY001 account can operate independently on this website. However, under the following circumstances, PROXY001 has the right to unify the processing of the same and/or associated legal entities' multiple PROXY001 accounts based on its judgment. Examples of associated information include: the same ID card, the same email, the same payment account, the same device, the same address, etc.
2.3.4 Your account and password are set and kept by you. You must keep your PROXY001 account and password confidential. You need to ensure that you properly log out of the website at the end of each online session.
2.3.5 If you discover unauthorized use of your PROXY001 account and password, you should immediately notify PROXY001; PROXY001 will assist you in freezing the account, changing the password, or making other security settings. You understand that it takes reasonable time for PROXY001 to act on your requests, and PROXY001 is not responsible for any consequences (including but not limited to your losses) incurred before taking action or caused by you.
2.3.6 PROXY001 will also adopt reasonable technical measures on the server side to secure your account.
III. Account Freezing, Cancellation, and Appeal
3.1 Account Freezing
Your PROXY001 account (all or partial permissions/functions) may be frozen in the following situations (e.g., PROXY001 account API unavailable), and PROXY001 will notify you via email or other means:
3.1.1. For the security of running and trading on the PROXY001 website or service, if you engage in or attempt to engage in activities that disrupt or seek to disrupt the normal use or operation of PROXY001 products, or any use involving the name, brand of PROXY001 or its affiliated companies which may mislead others, or any use of certain Chinese/English (full name or abbreviation), numbers, domains, etc., intended to indicate or map a relationship with PROXY001 or its affiliates;
3.1.2. Violation of these Service Terms, rules, regulations (such as usage rules, legal norms), service descriptions, and other service agreements/terms of the PROXY001 website;
3.1.3. Violation of national laws, regulations, policies, and legal documents;
3.1.4. If you are complained about by others and they have provided relevant evidence, but you fail to provide contrary evidence according to our requirements;
3.1.5. PROXY001 reasonably determines that there are abnormalities in your account operations, earnings, exchanges, etc.;
3.1.6. Freezing required by national competent authorities;
3.1.7. PROXY001 reasonably judges that you have engaged in behavior similar in nature or posing similar risks to the above behaviors.
3.2. Account Cancellation
3.2.1. If any of the situations described in Article 3.1 are serious, or based on the requirement of national competent authorities, your PROXY001 account (all or part of its permissions or functions) will be canceled, and PROXY001 will notify you via email or other means.
Website Services and Standards
4.1 You have the right to enjoy internet technology services and information services provided by PROXY001 through this website. At the same time, you should fulfill responsibilities such as timely payment and service management according to these Service Terms and related terms and conditions confirmed when purchasing specific services.
4.2 You agree to:
(i) Any content violating national laws, regulations, and policies;
(ii) Political propaganda and/or news information that violates national regulations;
(iii) Information involving state secrets and/or safety;
(iv) Superstitious and/or pornographic, lewd, offensive information or information inciting crime;
(v) Lottery games with prizes, gambling games; information violating national ethnic and religious policies;
(vi) Information obstructing internet operational safety;
(vii) Information infringing upon others' legitimate rights and interests and/or other information detrimental to social order, public security, and public morality;
(viii) You also commit not to provide any convenience for others to post the aforementioned non-compliant information, including but not limited to setting URLs, BANNER links, etc.;
4.2.2 No actions shall be taken that destroy or seek to destroy network security, including not utilizing technical or other means to disrupt or disturb this website and other customers' websites of PROXY001;
4.2.3 Your use of PROXY001 website services should comply with these Service Terms; if you violate the above guarantees, PROXY001 has the right to take measures such as deleting information, suspending services, terminating services, freezing, or canceling all or part of your account functions according to relevant service terms.
Five. Privacy and Personal Information Protection
Your trust is very important to PROXY001. We understand the importance of user information security and will protect your personal information in accordance with legal requirements and take security protection measures to ensure the controllability of your user information.
Six. Intellectual Property Rights
6.1 We respect intellectual property rights. Unless we obtain your consent, PROXY001 will not arbitrarily use, modify, copy, publicly disseminate, alter, distribute, issue, or publicly publish results of intellectual property rights owned by you.
6.2 Unless otherwise specified, trademarks, logos, texts, graphics, and their combinations such as "PROXY001", "PROXY001 Global", etc., as well as other marks, emblems, names of PROXY001 services, technical documentation, etc., of the PROXY001 website belong to PROXY001 and its affiliated companies.
6.3 You should respect the intellectual property rights and other lawful rights/benefits of PROXY001 and third parties, and guarantee to protect PROXY001 and its employees, shareholders, partners, etc., from being affected or losing due to illegal events involving infringement of the aforementioned rights/benefits. PROXY001 reserves the right to terminate providing services to you and not refund any amount if you infringe upon the legal rights/benefits of PROXY001 and/or other third parties.
Seven. Confidentiality
PROXY001 commits to taking confidentiality measures regarding information submitted or known to you when registering your account or using PROXY001 services, without disclosing your information to third parties unless:
7.1 Permitted by these Service Terms or other service agreements, contracts, online terms, etc., between you and PROXY001;
7.2 Required by laws, regulations, or judicial/administrative departments;
7.3 The confidential information has already been disclosed or can be obtained from the public domain without violating the provisions of these Service Terms.
Eight. Information Security Incidents
PROXY001 manages information security incidents in accordance with national laws and regulations and relevant standards for handling security incidents. When an information security incident involving your assets occurs, we will promptly inform you via email or other means in accordance with the law. You can also contact us proactively via email, customer service, key account managers, etc.
Nine. Scope of Liability and Limitation of Liability
9.1 You acknowledge and agree that you shall bear responsibility for any third-party claims resulting from your use of this service, violation of these Service Terms, or any action taken under your account. If this leads to claims against PROXY001 and its affiliated companies, employees, clients, and partners, you shall handle them and compensate PROXY001 and its affiliated companies for all losses and liabilities incurred thereby.
9.2 To the extent permitted by applicable law, PROXY001 does not assume liability for indirect, punitive, special, consequential damages arising out of or in connection with these Service Terms.
9.3 PROXY001 hereby reminds you that during your use of PROXY001 services, you must abide by the laws of the People's Republic of China, must not endanger cybersecurity, and must not use PROXY001 services to engage in activities that infringe upon others' reputation, privacy, intellectual property rights, and other lawful rights and interests. PROXY001 assumes no responsibility for your unlawful or breach-of-contract acts while using PROXY001 services.
9.4 In some cases, to help you more conveniently use PROXY001 services, PROXY001 may display reference codes or software (if belonging to third-party open-source software, you should comply with the relevant usage requirements of the third-party open-source software). Based on the usage instructions on the corresponding display page, such software may allow you to download, perform secondary development, and other related operations. You should understand and promise that the intellectual property rights of such codes belong to PROXY001, and you should clearly indicate the rights holder when using them. Meanwhile, PROXY001 is not responsible for whether you can use and work and the consequences of using such codes/software.
Ten. Force Majeure and Accidental Events
PROXY001's website may not operate normally due to the following force majeure or accidental events, and PROXY001 bears no liability for damage compensation:
10.1 Factors such as natural disasters, strikes, riots, wars, government actions, judicial administrative orders, etc.;
10.2 Power supply failures, communication network failures, and other public service factors;
10.3 System maintenance within a short period after prior announcement or notice.
Eleven. Applicable Law and Jurisdiction
The validity, interpretation, amendment, execution, and dispute resolution of these Service Terms shall be governed by the laws of the People's Republic of China. If any disputes arise over the content of this agreement or its execution, both parties should try to resolve them amicably. If negotiations fail, either party may submit to the court of its place of residence.
Twelve. Notice Delivery
12.1 You understand and agree that PROXY001 may send notifications to you via web announcements, emails, instant messaging, and one or more of the above methods, and PROXY001 can rely on the contact information you provided as complete, accurate, and currently valid; once the notification is successfully sent, it is deemed delivered.
12.2 Unless otherwise stipulated in these Service Terms or specifically agreed upon in another agreement signed between PROXY001 and you, notices you send to PROXY001 should be delivered through the official communication address, fax number, email address, etc., published by PROXY001.
Thirteen. Amendment and Termination of Clauses
13.1 PROXY001 has the right to amend these Service Terms and relevant service rules, and announce or notify changes via web announcements, emails, etc.; if you continue to use this service after the amendment of these Service Terms, it indicates that you have fully read, understood, and accepted the modified content and will follow the amended clause content.
13.2 These Service Terms terminate when your account is canceled or both parties reach a mutual agreement to terminate the website service.
Fourteen. Miscellaneous
14.1 These Service Terms consist of the content of these Service Terms, rules, regulations displayed on relevant pages of the website, service descriptions (including operating manuals), and other terms/conditions you click to confirm, and both PROXY001 and you are bound by them, with relevant terms mutually referencing and interpreting each other.
14.2 Chapter titles in these Service Terms are set solely for ease of reading and do not have legal or contractual effect.
14.3 If any clause of these Service Terms is deemed void, invalid, or unenforceable, that clause shall be considered separable and shall not affect the validity and enforceability of these Service Terms and other clauses.
14.4 PROXY001 reserves the right to transfer all or part of the rights and obligations under this Agreement to its affiliated companies by announcing on the official website of PROXY001 (proxy001.com) or sending stationery notifications, email notifications, etc.
14.5 Confidentiality clauses, intellectual property clauses, applicable law and jurisdiction clauses, and other clauses that logically should continue (such as guarantees of the authenticity of registration information) under these Service Terms shall remain effective even after termination of these terms.
14.6 Within the maximum scope allowed by relevant laws and regulations, PROXY001 retains the final interpretation right over this Agreement.
